Contract Attorneys Needed

Description of work:  The Office of Administrative Hearings contracts with attorneys to serve as counsel representing inmates and wards in hearings concerning authorization for involuntary administration of psychotropic medication by the California Department of Corrections and Rehabilitation and the California Youth Authority to individuals confined within their respective institutions.  The contract provides for reimbursement at the flat rate of $250 per case, a minimum of $500 per hearing, and $150 for assigned cases that do not go to hearing.  The hearings are conducted in prison facilities throughout the State.  Travel expenses or per diem are not reimbursed.

Qualifications:

1.  Practicing attorney for at least three years

2.  Preferred experience:

  • Riese, conservatorship, guardianship & capacity hearings
  • criminal defense or inmate advocacy
  • administrative hearings

3.  Preferred areas of knowledge:

  • Keyhea v. Rushen (1986) 178 CA3d 526
  • In the matter of Keyhea v. Rushen: Order Granting Plaintiff's Motion for Clarification and Modification of Injunction and Permanent Injunction (available at: www.documents.dgs.ca.gov/oah/forms/KEYHEA-67432.doc) and cases interpreting the Order
  • Lanterman-Petris-Short Act
  • Penal Code sections 2600, 5054 and 5058; and Code of Regulations, Title 15, Article 9, Section 3350.2 to 3369

4. Preference to attorneys in areas surrounding prison facilities
