Calendaring of Department of Developmental Services Hearings

All appeals/due process hearing requests arising out of the Lanterman Developmental Disabilities Services Act (Welf. & Inst. Code, § 4700 et seq.) and the California Early Intervention Services Act (Gov. Code, § 95000 et seq.), as well as all Residential Care Facility appeals (Cal. Code Regs., tit. 17, § 56061 et seq.) and Formal Audit appeals (Cal. Code Regs., tit. 17, § 50700 et seq.) should be filed initially with the OAH Statewide DDS Calendar Clerk in the Sacramento OAH office, not the local regional OAH office.  Regional Centers filing Lanterman Act Fair Hearing/Mediation Requests should use the OAH 21E, Regional Center Request to Set Lanterman Act Fair Hearing/Mediation form.  The Department of Developmental Services filing of Residential Facility Appeals and Audit Appeals should use the OAH 21A, Request to Set for State Agencies.  As of October 10, 2006, all filings should be sent to: 

Calendaring of Department of Developmental Services Mediations

The Office of Administrative Hearings conducts the mediations under the Lanterman Developmental Disabilities Services Act for the Department of Developmental Services. These mediation services are provided to regional center consumers, including those residing in state-operated facilities, who have requested a fair hearing, and who choose to participate in mediation. The calendaring of the mediations will be handled in the same manner as the calendaring of the hearings. Regional Centers filing Lanterman Act Mediation Requests should use the OAH 21E, Regional Center Request to Set Lanterman Act Fair Hearing/Mediation form.
